General Terms and Conditions (GTC EyeArt Vision GmbH)
Item 1. Validity of the GTC and conclusion of the contract
Section 1.01 These General Terms and Conditions (GTC) apply to purchase contracts with business customers and private customers that are concluded via the shop website eyeart.ch.
Section 1.02 For purchase contracts that are concluded in another way, e.B. by telephone, e-mail or letter, these GTC also apply. If a customer does not agree with the GTC in such cases, he can make use of his right of withdrawal, see section 7.3.
Item 2. Prices and special offers
Section 2.01 Prices are quoted in EURO. Shipping costs will be charged extra.
Section 2.02 EyeArt Vision GmbH(eyeart.ch) reserves the right to change prices atany time. For customers, the prices published on the website on the order date apply. The price is binding, obvious errors are reserved (e.B. 20.- instead of 200.-).
Section 2.03 The conditions for promotions and discounts can be found in the relevant information.
Item 3. Terms of delivery
Section 3.01 Delivery is usually made in the delivery times indicated in the product and only after receipt of prepayment. If a longer delivery period is necessary, the customer will be informed at the latest after expiry of this time.
Item 4. Shipping and Shipping Costs
Section 4.01 Shipping costs are not included in the shop prices. The shipping costs can be found in the shipping costs overview in the online shop. The packaging material is included in the shipping costs.
Section 4.02 Shipping usually takes place on the next working day after receipt of payment.
(a) Goods with stock: 7-10 days (A-Post Priority)
(b) Goods with stock backlog: 20-60 days
Section 4.03 If the goods are sent uninsured by post, the risk of loss by post lies with the buyer.
Section 4.04 Your goods will be shipped by Swiss Post. Unless otherwise agreed, the goods will be shipped with A-PostSwitzerland:

Item 5. Right of revocation and withdrawal
Section 5.01 Customers can cancel the purchase contract within 7 days without giving reasons and without penalty. The period for exercising this right begins on the day on which the goods arrive at the consumer. The customer can return goods already delivered at his own expense. Payments already made will be refunded by the provider minus shipping costs
Section 5.02 If a customer withdraws from the purchase due to defects in the goods or other reasons for which the provider is responsible, the provider will refund amounts already paid.
Section 5.03 If the customer wishes to withdraw from his/her order, the customer must report this in writing within 5 days, otherwise the standard conditions apply and the customer must pay the invoice, even if he/she has not yet received the goods because his/her creditworthiness has not allowed to send the goods in advance. Personal reasons do not justify ordering and not paying, the customer must take responsibility.
Item 6. Return
Section 6.01 You have an unlimited right of return of the entire delivery within 7 days of the delivery date. This refers to the entire delivery and all goods received. The goods must be returned in unused, unaltered condition in undamaged packaging to the sender of the delivery (usually EyeArt Vision GmbH). In the case of hidden defects, these must be communicated in writing, otherwise no credit note or replacement delivery can be made. A claim to a credit note arises.
Item 7. Liability and guarantee
Section 7.01 The buyer must inspect the delivered goods as soon as possible and report defects immediately. Secret defects can still be complained about even after commissioning or use of the goods. The payment of payments shall not be deemed a waiver of notice of defects.
Section 7.02 If there is a defect, the buyer has the choice to demand free repair, to withdraw from the contract or to obtain a replacement delivery. The right of the buyer to claim damages remains reserved in all cases.
Item 8. Payment
Section 8.01 Payment is usually made on account, prepayment, Postcard or credit card or PayPal.
Section 8.02 In case of late payment, EyeArt Vision GmbH (eyeart.ch) will send a maximum oftwo reminders. For the second reminder a fee of EURO 20.- will be charged. If the customer then does not pay, enforcement measures will be initiated. In addition, default interest of 5 percent will be charged in the event of late payment. Claims for damages are reserved.

(i) For each order, a credit check of customers (Intrum AG, Eschenstrasse 12, 8603 Schwerzenbach) is carried out via the online platform provided. In the case of an unpaid invoice, legal recourse is taken via Intrum AG.

(d) Cash on delivery ( a flat rate of 15.00 EURO will be added)
(e) Transfer in advance to the specified account within 7 days.

Item 9. Payment
Section 9.01 Orders are binding, you must understand that sent orders are binding, even if your creditworthiness does not allow us to send the products on account you have to pay the invoice. After that, you will receive your products as desired.
Section 9.02 We only send new customers the products on account that have been positively credited.
Item 10. Liability for the online connections
Section 10.01 EyeArt Vision GmbH (eyeart.ch) undertakes to ensure state-of-the-art security in systems, programs, etc. that belong to it and over which it has influence, as well as to comply with the rules of data protection.
Section 10.02 Customers must ensure the security of the systems, programs and data that are under their control. In their own interest, customers should keep passwords and user names secret from third parties.
Section 10.03 EyeArt Vision GmbH(eyeart.ch) isnot liable for defects and malfunctions for which it is not responsible, especially not for safety defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
Section 10.04 Furthermore, EyeArt Vision GmbH (eyeart.ch) is not liable forforce majeure, improper action and disregard of the risks on the part of the customer or third parties, excessive stress, unsuitable operating resources of the customer or third parties, extreme environmental influences, interventions of the customer or disturbances by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.
Item 11. Application of law and place of jurisdiction
Section 11.01 It applies to all deliveries, within Switzerland and abroad, exclusively under Swiss law. Place of jurisdiction is 6340 Baar, resp. The registered office of the subcontractor.
Section 11.02 Our debt collection partner is Intrum AG in Schwerzenbach,
Intrum AG is authorized to collect all mandates handed over within the framework of the general business regulations.
